Making Decisions Alliance welcomes consultation on advocacy services for vulnerable people

The Making Decisions Alliance (MDA), a coalition of charities that campaigned for the Mental Capacity Act, welcomes the publication of the government’s consultation on Independent Mental Capacity Advocates (IMCAs), but wants to see the government communicate effectively with the people whose interests are at the heart of the Act.

Toby Williamson, Co-Chair of the MDA says, “It is critically important that the consultation process involves people for whom IMCAs are intended, such as people with learning disabilities or older people. We urge the government to ensure the process is done in ways accessible to those individuals and to pro-actively consult with the ‘harder to reach’ groups in a variety of different ways.”

The Alliance would also like to see provision of advocacy broadened in scope.

Richard Kramer, Co-Chair of the MDA says,

“It is crucial that the Independent Mental Capacity Advocacy service is available for a wider range of people than the Act currently states. People who may have a relative or friend but who still need support and representation when dealing with the health and social care system should also have access to advocacy if needed”.

The purpose of the Independent Mental Capacity Advocate service will be to work in the interests of vulnerable people who lack capacity and who are facing important decisions about serious medical treatment and changes of residence, but have no-one else to represent and support them.

The Department of Health has just announced its 3 month consultation on the independent mental capacity advocate service which will be part of the Mental Capacity Act for England and Wales, due to come into effect in 2007. The consultation runs until the 30th September 2005 and you can find out more at:
